Injury Cases

Merkle Law Firm is paid on a contingency fee basis.  That means you don’t pay legal fees or costs up front. The Firm will advance your legal costs and expenses so you don’t have to.  Attorney fees are paid as a percentage of the amount you are paid in the final recovery. That simply means you will not get a legal bill.  The fees will be paid at the end when you win.  The law firm is paid a percentage of the final settlement you receive.

Many people try to pursue their own claims so they don’t have to pay an attorney.  However, that is like walking into a gun fight without a gun.  It is important to know that insurance companies will only pay large sums of money when they are forced to do so. Consequently, the only way to force them to pay is by taking them to court or by the threat of going to court.   Contact Merkle Law Firm right away to protect yourself.

About Merkle Law Firm

Bret Merkle graduated in 1991 from the University of South Dakota with a Juris Doctorate and a Master of Business Administration. He is a member of the South Dakota Bar Association and the South Dakota Trial Lawyers Association.  Bret has specialized in personal injury trial law for over 25 years representing clients who have been injured by the fault of others.  Bret is also a graduate of the Gerry Spence Trial Lawyers College.  He was invited back to the college as an instructor where lawyers are trained how to communicate openly and honestly with the jury to reveal the truth of their clients’ cause.

Many people think they need to hire a lawyer from a large law firm to get the best representation. Bret has fought against the largest law firms and the best lawyers for over 25 years, and has consistently won large verdicts and settlements for clients.  When you come to Merkle Law Firm for your first visit, you will meet Bret himself and talk about your case.  You will work with Bret personally throughout your case.  He will answer your calls, emails and texts messages promptly, and he will communicate with you directly.

Bret’s staff is also extremely professional, yet personal to your needs. Lona Sue Jensen is Bret’s certified paralegal.  You will work directly with Sue as well.  She has handled personal injury cases for over 37 years.  She works directly with the insurance adjusters, medical providers, defense lawyers, and judges to make your case move smoothly through the process. Bret's other paralegals are excellent at organizing, analyzing, and preparing your personal injury case.  They have extensive experience working in litigation, preparing legal documents, and will work directly with you to gather all the information needed to present your case.  Bret also works directly with a nurse paralegal who is a registered nurse.  She was trained by and worked for an insurance company.  There she learned what the insurance companies look for to deny or minimize personal injury claims.   She is an expert at gathering, reviewing, and analyzing medical records to prove your injuries and your losses.  Bret also hires the best experts in their respective fields to prepare your case for success, such as medical, accident reconstruction, and engineering experts so your rights will be protected and your losses will be proven to obtain fair results.

Bret’s motivation to help injured people with their legal injury claims comes from his involvement in a motorcycle accident.  His personal experience with injuries and loss gives him a unique perspective to represent his clients and argue their causes.  He understands the pain and struggle his clients are forced to endure, and he has made it a mission in life to help them through their own tragedies.

Bret is married to Marie and they have five children. They live on an acreage close to Sioux Falls and enjoy family life in South Dakota.
