A man in his mid-30s was injured when a truck lost its load of steel on the interstate causing the vehicle behind it to swerve, lose control, and hit his vehicle head-on at 65 mph. He suffered a brain injury.
A lady suffered a broken ankle and shoulder when her vehicle was struck head-on at 55 mph by another vehicle after it swerved to avoid a deer in the road. The driver and passenger in the vehicle causing the accident were killed. Neither driver had insurance. Investigation revealed our client was driving a vehicle owned by her father. Our firm made a claim against the father’s insurance policy for Uninsured Motorist coverage.
A 73-year-old man was injured when a semi-tractor-trailer pulled out in front of his vehicle as he was towing a fifth-wheel camper. The case was tried to a Minnesota jury. During the case, the bank foreclosed on our client’s home because his injuries would not permit him to work. Merkle Law Firm also defended the foreclosure action saving his home.
A married couple was seriously injured when a 16-year-old boy pulled out from a stop sign onto an Iowa highway. A semi-tractor-trailer hit the boy’s vehicle, then collided with the couple’s vehicle and another pickup truck. An accident reconstructionist found the truck driver was speeding at the time of the collision, rendering him liable for contributing fault pursuant to Iowa comparative fault statutes. Settlement was obtained from the auto insurance policy of the boy’s parents and the commercial fleet insurance coverage of the trucking company.
A young woman in her early 30s was struck by a pickup truck while she was walking on a city sidewalk. She sustained multiple fractures, broken bones, and lacerations. Our firm obtained a lifetime structured settlement for her.
A young lady was attacked by a vicious dog while on the job, leaving her with scars and emotional trauma. A combined settlement was obtained from the homeowner’s insurance of the dog owners, workers’ compensation insurance, and the City for failure to enforce vicious dog ordinances.
A 32-year-old man was killed when his pickup truck was hit head-on by a grain truck on a gravel road. The grain truck driver argued that the deceased was driving over the imaginary center line of the gravel road. Settlement was obtained weeks before a scheduled jury trial from the truck driver’s general farm liability insurance policy.
A 53-year-old man sustained injuries to both shoulders while on the job when a heavy motor fell on him. Prior injuries to his neck and back had rendered him disabled before the work injury. A combined settlement was obtained with the general contractor’s commercial liability coverage and workers’ compensation.
A middle-aged woman was rear-ended by a semi-tractor trailer on the interstate. She sustained a broken vertebra.
In an Insurance Bad Faith claim, client lost his barn to a fire. His insurance company refused to pay his losses fairly. A lawsuit was filed against his insurance company and a fair settlement was obtained days before trial.
A young man in his early 20s was set on fire as a joke by an acquaintance. Merkle Law Firm made a claim against the acquaintance’s homeowner’s insurance policy and negotiated a settlement for the policy limits.
A self-employed handyman suffered a back injury when he fell off a ladder while attempting to cut a tree limb with a chainsaw. Our firm represented him against the property owner and obtained a settlement from his property insurance company.
A lady sustained back injuries in a car accident. Our firm obtained the insurance policy limits from the liability insurance company of the person who caused the accident, as well as policy limits from our client’s Under Insured Motorist insurance.
A teenage passenger in a car was injured when her friend lost control and rolled the vehicle. Our client suffered a scar above her eye when she was cut by broken glass. The driver was uninsured, but she was driving her father’s vehicle. Merkle Law Firm obtained a settlement from the father’s auto insurance policy.
A schoolteacher injured her right dominant hand when she opened a gate with no safety guard. Her hand was crushed and required surgery to repair. A combined settlement was obtained with the fence/gate installer’s commercial liability insurance and workers’ compensation.
A 60-year-old man reinjured a pre-existing back injury while working for a fuel delivery company. A permanent total disability claim was made and settled with the employer’s workers’ compensation insurance.
An interior decorator sustained a shoulder injury when her vehicle was struck by a tire that flew off a pickup truck and bounced into her windshield. It was proven that the tire came off because the auto service center employee failed to properly tighten the lug nuts. A combined settlement was obtained from the car dealer’s commercial liability insurance and workers’ compensation.
A driver for a major parcel delivery company suffered a back injury on the job. Our firm obtained a settlement for him, including permanent total disability.
Our client suffered an aggravation to a prior back injury when his vehicle was hit by another driver who ignored a stop sign.
A middle-age salesman was injured when he slipped and fell while on the job. Merkle Law Firm obtained a settlement including permanent total disability for his neck injury.
While walking through a high school parking lot, a 17-year-old suffered shoulder, whiplash and back injuries when he was hit by a speeding car driven by another teenager. The driver was cited for reckless driving. A settlement was obtained from the auto insurance policy of the driver’s parent.
A road construction crew went to a bar; and after a night of drinking, they attempted to drive home. One of them crawled onto the hood of the company truck as it sped down the road at 80 mph, and he was thrown off as it rounded a curve. He was killed instantly. The blood alcohol content of both the driver and the man killed was more than twice the legal limit. Merkle Law Firm represented the estate of the man who was killed and obtained a settlement from the employer construction company for its negligence in allowing a known DUI felon to drive its company vehicle.
A delivery employee slipped and fell on ice injuring his shoulder while making a delivery to a grocery store. The fall occurred in the parking lot of the store where deliveries are supposed to be made. A combined settlement was obtained from the store’s commercial liability insurance for the store’s failure to maintain a safe premise, along with the employer’s workers’ compensation insurance.
Our client sustained permanent nerve damage to his lower leg in a head-on collision at 55 mph when the driver of the oncoming vehicle negligently crossed the center line.
A man in his early 30s suffered whiplash neck injuries in an automobile collision. He could no longer perform the duties of an auto mechanic, and he was forced to change his occupation.
A Sudanese immigrant in his early 30s suffered a broken leg when his landlord failed to properly repair a sliding glass door. The door fell on him, knocking him over the railing of his third-floor apartment balcony. Our firm obtained a settlement from the landlord’s commercial insurance company.
A 70-year-old lady slipped on water near a cooler in a truck stop in Columbia, Missouri. She sustained an aggravation to a prior injury to her knee. Our client’s doctor had recommended a knee replacement prior to the fall, but he provided a medical opinion stating the fall at the truck stop accelerated the need for the knee replacement. A settlement was obtained from the truck stop’s commercial liability insurance.
A passenger suffered aggravated low back and whiplash injuries in an auto collision. Merkle Law Firm settled for the insurance policy limits of the offending driver, but that amount did not cover all the damages to our client. The vehicle in which our client was a passenger carried Under Insured Motorist insurance coverage, and we made a claim against that insurance policy to pay the remaining damages.
A property owner drained water from a sump pump hose across a city sidewalk, creating a slippery and dangerous condition. Our client sustained a wrist injury when she slipped and fell on the sidewalk. Merkle Law Firm negotiated a settlement against the property owner’s homeowner’s insurance policy.
Our client suffered an injury to her arm and wrist when she slipped and fell on an ice-covered sidewalk after a snowstorm. Our firm made a claim against the commercial insurance policies of two businesses that failed to remove the snow and ice from the sidewalk.
Our client suffered whiplash back injuries in an auto collision. A settlement was reached with the driver of the vehicle causing the collision for the insurance policy limits. Another claim was made against our client’s Under Insured Motorist insurance coverage. The case was tried before a jury on the Under Insured Motorist claim.
